Swimming pools in Bergen County must be enclosed by barriers at least 4 feet high with self-closing, self-latching gates, as required by the New Jersey Uniform Construction Code adopting the International Residential Code pool barrier provisions.
Pool barrier requirements throughout Bergen County follow the IRC Appendix G and ICC pool/spa code adopted under N.J.A.C. 5:23. Barriers must be at least 48 inches high measured from the exterior side, with no openings allowing passage of a 4-inch sphere. Gates must open outward away from the pool, be self-closing and self-latching, with latch release mechanisms at least 54 inches above grade. Where a dwelling wall serves as part of the barrier, doors leading to the pool area must have alarms or other approved safety devices. Above-ground pools with non-climbable sides may use the pool wall as a barrier when ladders are removable.
Failure to install compliant barriers may result in failed inspections, denied certificates of approval, civil penalties, and potential liability exposure under New Jersey premises liability law.
