Dubuque, IA Swimming Pools & Spas: Fencing & Safety Requirements (2026)

City Code 14-9-4 directs that swimming pool fencing must comply with section 303 of the International Property Maintenance Code. The city's own amendment to that section, adopted at City Code 14-1J-2 (amending IPMC section 303.2, "Enclosures"), sets the actual standard: private swimming pools, hot tubs and spas capable of holding water more than 24 inches deep must be completely surrounded by a fence or barrier not less than 48 inches high, measured on the side away from the pool. Gates and doors in the barrier must be self-closing and self-latching.

If the self-latching device sits lower than 54 inches above the bottom of the gate, the release mechanism must be on the pool side of the gate, and the gate must positively close and latch when released from 6 inches open. The amendment also bars removing, replacing or altering an existing pool enclosure in a way that reduces its effectiveness as a safety barrier. Enforcement of the Dubuque Property Maintenance Code falls to the Inspection & Construction Services Division (Housing and Community Development/Building Services Department) under City Code 14-1J-2's amendment of IPMC section 103.1, and violations can be pursued through a notice of violation, municipal infraction, or lien for abatement costs under the escrow and fee provisions the same amendment adopts for IPMC sections 104.1 and 109.5.
