Franklin pool barriers are governed by Section 305 of the International Swimming Pool and Spa Code as adopted by the City (2018 ISPSC for plans pre-1/1/2026, 2024 ISPSC via Ordinance 2025-37 thereafter). The barrier must be at least 48 inches above grade on the side facing away from the pool, openings may not allow a 4-inch-diameter sphere to pass, gates must be self-closing, self-latching, and open outward away from the pool, and the latch must be at least 54 inches above the bottom of the gate. Climbable objects may not be located so as to defeat the barrier.
ISPSC Section 305 (Barrier Requirements) as adopted by the City of Franklin (Title 12, Chapter 7 of the Franklin Municipal Code) sets the detailed standard. Key provisions: (1) 'The top of the barrier shall be at least 48 inches (1219 mm) above grade where the measurement is taken on the side of the barrier which faces away from the swimming pool.' (2) The maximum vertical clearance between grade and the bottom of the barrier is 2 inches (or 4 inches when measured on the side of the barrier facing the pool). (3) 'Openings in the barrier shall not allow the passage of a 4-inch-diameter (102 mm) sphere.' (4) Solid barriers shall not contain indentations or protrusions except for normal construction tolerances and tooled masonry joints. (5) For fences where horizontal members are less than 45 inches apart, the horizontal members shall be on the swimming pool side, and spacing between vertical members shall not exceed 1-3/4 inches in width. (6) Chain-link mesh size shall not exceed 1-1/4 inches square unless the fence is provided with slats fastened at the top or bottom that reduce the openings to not more than 1-3/4 inches. (7) Where the barrier is composed of diagonal members, the maximum opening formed by the diagonal members shall not be more than 1-3/4 inches. Gates per ISPSC 305.3: shall comply with the barrier requirements; pedestrian access gates shall open outward away from the pool, shall be self-closing and self-latching, and shall be equipped with a locking device. If the release mechanism is located less than 54 inches from the bottom of the gate, it shall be located on the pool side at least 3 inches below the top of the gate, and the gate and barrier shall have no opening greater than 1/2 inch within 18 inches of the release mechanism. ISPSC 305.4 (Dwelling wall as a barrier): where a wall of a dwelling serves as part of the barrier, doors with direct access to the pool must have an alarm complying with UL 2017, a self-closing/self-latching device with the release at least 54 inches above the floor, a powered safety cover complying with ASTM F 1346, or other approved means of protection. The City's Swimming Pool Procedures confirm: 'An outdoor swimming pool, including an in-ground, aboveground or on-ground pool, hot tub or spa shall be provided with a barrier' and 'Openings in the barrier shall not allow passage of a 4-inch opening' and 'Barriers shall be located so as to prohibit permanent structures, equipment or similar objects from being used to climb the barriers.'
Failure to maintain a compliant barrier is the most common pool-code violation. Self-closing gates that have failed, latches below 54 inches that are not pool-side, openings larger than 4 inches, and barriers under 48 inches all trigger code-enforcement action. Climbable objects (chairs, ladders, AC units, planters) within reach of the barrier must be removed. Building and Neighborhood Services may require the pool to be drained or covered until violations are corrected.
