Pool barrier requirements in Montgomery County are set by the Pennsylvania Uniform Construction Code (Act 45 of 1999, 35 P.S. §7210.101 et seq.), which adopts the International Residential Code Appendix AG105 statewide for residential pools. Barriers must be at least 48 inches high, with gates self-closing, self-latching, and opening outward. The UCC is enforced by municipal code officials.
Pennsylvania has had a statewide construction code since the Uniform Construction Code (UCC) took effect April 9, 2004 under Act 45 of 1999 (35 P.S. §7210.101 et seq.). The UCC adopts the International Code Council's IRC, IBC, IFC, IPC, IMC and IECC with PA-specific amendments under 34 Pa. Code Chapters 401-405. For private residential pools, IRC Appendix AG105 governs barriers. The barrier must be at least 48 inches high measured from the outside grade. Openings in the barrier may not allow passage of a 4-inch sphere. Where the barrier is a chain link fence, mesh size cannot exceed 2.25 inches square unless slats are installed. Gates must open outward away from the pool, be self-closing, and have self-latching devices. If the latch release is on the pool side, it must be at least 3 inches below the top of the gate. Where the latch release is otherwise mounted, it must be at least 54 inches above the ground. Pools 24 inches or more in depth at any point are regulated. The UCC is enforced by your municipal building code official; in opt-out municipalities, by the PA Department of Labor & Industry.
PA UCC violations under 35 P.S. §7210.903 are summary offenses punishable by fines up to $1,000 per violation, plus stop-work orders by the building code official. Each day of continued violation may constitute a separate offense. Municipalities may impose additional penalties under their local building code enforcement ordinance. Civil liability for pool drowning where barriers are non-compliant can be substantial.
