Private backyard pools, spas, and hot tubs are governed by the Indiana Residential Code Section R326, which requires a barrier at least 48 inches high measured from the outside, with gaps limited so a young child cannot pass. Above-ground pools and spas with an approved lockable safety cover can meet the requirement differently.
For public pools, operating without a compliant enclosure is a nuisance violation with a fine up to $500. Private-pool barrier failures are enforced through the county building department and Indiana Residential Code.
