NJ Barrier Subcode (N.J.A.C. 5:23-2.14(b)) is among the strictest in the nation. Minimum 48-inch barriers with self-closing, self-latching gates required.
The NJ Barrier Subcode (N.J.A.C. 5:23-2.14(b)) requires pool barriers for all residential swimming pools and spas. Barriers must be at least 48 inches high with no climbable features. Gates must be self-closing and self-latching. The house wall can serve as part of the barrier if doors have alarms or self-closing mechanisms. Pool covers meeting ASTM F1346 may serve as alternative barriers. NJ requires pool barrier compliance at time of property sale - non-compliant properties must be brought into compliance.
Non-compliant barriers: immediate correction. Fines $100 to $1,000. Real estate transactions: must comply before sale.
