Florida Statute 515.27 establishes the strictest residential pool safety law in the nation. Every new residential swimming pool in Port St. Lucie must be enclosed by a barrier at least 48 inches high measured from the ground on the outside. The barrier cannot have openings greater than 4 inches, must have no climbable features within 48 inches of the top, and must be positioned to prevent the pool from being accessed directly from the home. Gates must open outward, be self-closing and self-latching, with the latch at least 54 inches above the ground. In addition, the pool must be equipped with at least one of: (a) an approved pool safety cover; (b) an exit alarm on all doors and windows with direct access to the pool; (c) self-closing self-latching devices on all doors with direct access to the pool; or (d) a pool alarm. Port St. Lucie enforces these standards through the Building Department at permit issuance and final inspection. Existing pools sold must be brought into compliance at change of ownership under FL 515.27(3).
