Takoma Park enforces Montgomery County pool barrier requirements under Chapter 29 of the county code. All residential swimming pools must be enclosed by a fence or barrier at least 48 inches high with self-closing, self-latching gates. Gate latches must be positioned at least 54 inches above the ground or on the pool side of the gate to prevent child access. The city follows the International Swimming Pool and Spa Code as adopted by Montgomery County.
Takoma Park follows Montgomery County's building and safety codes for swimming pool barriers. Under Montgomery County Code Chapter 29 and the International Swimming Pool and Spa Code, all residential swimming pools capable of holding 24 or more inches of water must have a permanent barrier at least 48 inches high completely enclosing the pool area. Barriers must not have openings that allow passage of a 4-inch sphere. Gates in pool barriers must be self-closing and self-latching with the latch mechanism at least 54 inches above the ground or on the pool side with a release mechanism shielded from reach by small children. Chain link fencing used as a barrier must have no more than 1.75-inch openings. Walls of a dwelling may serve as part of the barrier if doors opening to the pool area are equipped with alarms or self-closing devices. Pool covers alone do not satisfy the barrier requirement. Permits for pool installation are issued through Montgomery County Department of Permitting Services at 240-777-0311. Inspections are required before the pool may be filled and used.
Failure to maintain required pool barriers is a code violation subject to Montgomery County enforcement. Fines may be assessed for each day of noncompliance. The county may issue stop-work orders on pool construction lacking approved barrier plans. Pools found without compliant fencing during inspection will not receive final approval.
