Under Tempe's building code (adopting the International Residential Code and Arizona pool barrier requirements), all swimming pools must have a barrier at least 5 feet high surrounding the pool area. Gates must be self-closing and self-latching with the latch at least 54 inches above grade. The barrier must not have openings that allow passage of a 4-inch sphere. Doors from the house to the pool area must have alarms or self-closing mechanisms. Existing pools must also comply when sold or during major renovation.
Non-compliant pool barriers are a serious safety violation. The city may issue immediate correction notices and can impose daily fines until compliance is achieved. Drowning incidents may result in criminal liability for the property owner.
