Under City Code Sec. 18-50, "a spa is a swimming pool," and the definition expressly includes jacuzzis, hot tubs, and whirlpools. A hot tub therefore meets the same barrier rules as a pool under Sec. 6-14, a 4-foot enclosure in Single-Family Residential zones or 6 feet elsewhere with self-closing, self-latching gates, and it must be kept clean and free of stagnant water under Sec. 18-50. Sec. 10-79(j) exempts portable spas from the pool water-line setbacks, but a permanent spa follows the 5-foot setbacks from the house and lot lines. Electrical work needs a permit and GFCI protection under the adopted building code.
An uncovered or unfenced spa is an attractive nuisance under Sec. 18-50; Code Enforcement can declare it a public nuisance and cite the owner, each day a separate offense.
