Tyler requires every pool holding water over 18 inches deep to be enclosed. Single-family residential lots (R-1A through R-1D) need at least 4 feet; all other pools need 6 feet. Gates must be self-closing and self-latching.
City Code Sec. 6-14 defines a swimming pool as any structure or excavation holding water over 18 inches deep for bathing or swimming. In Single-Family Residential zones (R-1A, R-1B, R-1C, R-1D) the enclosing fence, wall, or building must be at least 4 feet high; everywhere else it must be at least 6 feet. Fences cannot have openings larger than 4 inches, must resist climbing from outside, and cannot be built of wire. Gates need self-closing, self-latching devices with the latch on the upper quarter of the gate, on the inside. House doors forming part of the enclosure must be equipped the same way.
An unfenced or unlatched pool is an attractive nuisance; Code Enforcement can order correction and cite the owner under City Code, with each day of noncompliance a separate offense.
