City Code Sec. 18-50 makes pool safety a code-enforcement matter, calling pools and spas attractive nuisances to children. Whenever a pool or spa holds any water, the owner must keep the water clear enough to see the bottom, free of debris, and free of harborage for mosquitoes, snakes, and vermin; maintain fencing and gates under Sec. 6-14; and lock all access gates on unoccupied property. A pool that fails any of these, including an abandoned or algae-filled pool, is declared an unlawful public nuisance. Federal law, the Virginia Graeme Baker Act, separately requires anti-entrapment drain covers on pools and spas.
Code Enforcement inspects and can declare a noncomplying pool a public nuisance, correct it at the owner's expense, and assess a lien; penalties follow City Code Section 1-4.
