Every public or semi-public pool and spa in Allen County must hold a permit from the Fort Wayne–Allen County Department of Health before operating. Private backyard residential pools are permitted through building/zoning, not the Health Department.
Allen County Code Title 10, Article 5 governs public and semi-public pools. Each pool structure requires a permit issued by the Health Commissioner, posted on-site. Seasonal pools (May–September) pay a $250 permit fee; year-round pools pay $450, submitted with the application. Additional pools at the same address cost $80 (seasonal) or $120 (annual) each. Permits run one year, are non-transferable, and non-refundable. The Department inspects seasonal pools at least once a year (a week before opening) and annual-permit pools at least twice a year. Backyard residential pools are not permitted by the Health Department but must meet the Indiana Residential Code and county building rules.
