When a permit is issued for a new or remodeled pool or spa, California law requires at least two of seven approved drowning-prevention features, such as an isolating enclosure, safety cover, alarms, or self-closing self-latching doors. Cupertino applies this at permit issuance.
Under the California Swimming Pool Safety Act (Health and Safety Code Section 115922), applied in Cupertino through its adopted building code, any building permit for a new or remodeled single-family pool or spa must include at least two of seven drowning-prevention safety features. The seven options are: an isolating enclosure meeting Section 115923; ASTM F2286 removable mesh fencing with a self-closing, self-latching gate; an ASTM F1346 approved safety pool cover; self-closing, self-latching devices on home doors with direct pool access (release at least 54 inches high); an ASTM F2208 pool alarm; exit alarms on doors with direct access; or other approved protective devices. The Building Division verifies these features during inspection before finalizing the permit.
Failing to install at least two approved safety features prevents permit finalization and can result in reinspection, correction orders, and denial of occupancy for the pool.
