Full Breakdown

San Jacinto sorts every business into a category before it computes a fee, and the sorting rule sits in § 5.08.120. Category A, Rental Space, covers each apartment, business office, hotel, motel, storage building, mini-storage building, open area storage space, convalescent home, nursing home and hospital, at a minimum of $70.00 per year for the first four units plus $1.00 per year for each unit or space over four. Category B, Retail/Sales, covers businesses that derive 75% of total revenues from retail sales, such as a grocer, florist, restaurant, liquor store or tavern and bar, at a $70.00 annual minimum that includes one owner, manager, agent or employee. Category C covers businesses whose primary purpose is manufacturing or wholesaling at a fixed place of business, again with a $70.00 minimum. Category D, Professionals and Service, is the catch-all for any business or calling not specified in another category, with a $70.00 minimum that includes one principal plus $25.00 for each additional principal or professional at the same address who is not an employee.

Categories B, C and D add the graduated scale in § 5.08.060, which prices full-time employees in bands: $10.00 for 1 or 2, $30.00 for 3 to 6, $50.00 for 7 to 10, and so on up to $200.00 plus $5.00 for each employee over fifty. Three part-time employees working no more than twenty-five hours each per week count as one full-time employee. Category E lists contractor trades with a fee for each, and Category F lists special businesses at fixed fees.

Section 5.08.020 bases fees on a fixed fee, the graduated scale, the graduated scale with a minimum, or gross receipts. A business named nowhere in the chapter pays $60.00 plus the scale under § 5.08.050, and an out-of-town business pays twice the prescribed fee under § 5.08.040. Under § 5.04.200(C), a business that fits two categories pays on the basis that produces the highest fee. The city council amends the fees by resolution under § 5.08.010.

Violations & Fines

Carrying on business in the City of San Jacinto without a license is an infraction under § 5.04.510, punishable by a fine of not more than $500.00, and § 5.04.520 makes each day the business is carried on a separate violation. A business that starts operating before applying for and securing a license adds a penalty of fifty (50) percent of the fee or $20.00, whichever is higher (§ 5.04.360). A renewal unpaid thirty days after expiration is delinquent under § 5.04.350.

Frequently Asked Questions

How much is a basic business license in the City of San Jacinto?
Categories A through D each carry a $70.00 per year minimum under § 5.08.120. Category A adds $1.00 per year for each unit or space over four. Categories B, C and D include one owner, manager, agent or employee, then add the graduated employee scale in § 5.08.060, which starts at $10.00 for 1 or 2 full-time employees.
What category covers a business the code does not name?
Category D picks up any other business or calling not specified in some other category in the chapter. Separately, § 5.08.050 sets a license fee of $60.00 plus the graduated employee scale for a business not specifically mentioned in the chapter for assigning a fee rate. The code prints both rules, so the collector assigns the fee from them.
What if a business operates at two locations?
Section 5.04.200 requires a separate license for each business and for each branch establishment or location. Where a fee is imposed and the business has branches or separate fixed places, the fee is computed as if each branch or place were a separate and independent business.
Can the San Jacinto city council change the fees?
Yes. Section 5.08.010 says the fees set in the chapter can be amended by resolution of the city council at such time and in such manner as the city council deems advisable, so the figures in § 5.08.120 are the starting point and the current resolution controls any change.
