Summary
Chelsea bars every retailer, of any age restriction, from selling, possessing for sale or distributing a flavored tobacco product or a tobacco flavor enhancer. Flavor covers menthol, mint, fruit, candy, chocolate and dozens of other tastes, and manufacturer marketing claims alone can prove a product is flavored.
Flavored Tobacco Product: ... Any tobacco product or component part thereof that contains a constituent that has or produces a characterizing flavor. A public statement, claim or indicia made or disseminated by the manufacturer of a tobacco product, or by any person authorized or permitted by the manufacturer to make or disseminate public statements concerning such tobacco product, that such tobacco product has or produces a characterizing flavor shall constitute presumptive evidence that the tobacco product is a Flavored Tobacco Product. ... H.Sale of Flavored Tobacco Products Prohibited: No person shall possess, hold, keep, sell or distribute or cause to be possessed, held, kept, sold or distributed any flavored tobacco product, as defined herein, or any flavored tobacco product enhancer, as defined herein. Retailers must obtain from a manufacturer documentation as defined herein, certifying that products sold by the retailer, do not meet the definition of a flavored tobacco product or tobacco product flavor enhancer (105 CMR 665.010).

Full Breakdown
The Chelsea Board of Health's tobacco regulation defines Characterizing Flavor broadly to include any distinguishable taste or aroma other than tobacco itself, naming fruit, chocolate, vanilla, honey, candy, cocoa, dessert, alcoholic beverage, menthol, mint, wintergreen, herb and spice as examples, and treats a manufacturer's own public statement that a product is flavored as presumptive proof under the regulation. 010. The ban reaches beyond the state's youth-access flavor restriction because it applies to every retail sale regardless of the buyer's age; the only carve-out in the surrounding regulation is for oral nicotine pouches, which may still be sold, but only inside an adult-only retail tobacco store that already bars entry to anyone under 21.
The regulation took effect January 1, 2025, and sits within the same 2024 overhaul that raised Chelsea's cigar minimum pricing and banned self-service tobacco displays, vending machines and blunt wraps citywide. The Board adopted it under its general health-regulation authority in Massachusetts General Laws Chapter 111, Section 31.
Violations & Fines
A first violation of the flavor ban draws a $1,000 fine, rising to $2,000 for a second violation within 36 months and $5,000 for a third or later violation in that window; a sale to an underage buyer additionally suspends the retailer's Tobacco Product Sales Permit for three to thirty business days depending on the violation count. Four violations, or repeated egregious noncompliance, can lead to a Board of Health hearing and permanent permit revocation, and each day a violation continues counts as a separate offense.
