Flavored cigars, smokeless tobacco, hookah, and many vape flavors continue to be sold by permitted retailers in the city, subject to age-21 sales rules under Texas Health and Safety Code Β§161.0815. Future federal FDA actions on menthol cigarettes or flavored cigars could change product availability without any local action.
City code creates no flavor-specific violations. Selling FDA-unauthorized flavored vape products can still trigger federal enforcement and seizure actions independent of local rules.
