Under DC Code 7-1803.03, retailers within 300 feet of a public, charter, or private school may not sell tobacco products with characterizing flavors other than tobacco, including menthol, mint, wintergreen, candy, fruit, dessert, or alcohol flavors. The DC Council expanded the ban in 2022 to apply citywide for menthol cigarettes and flavored cigars, mirroring FDA's pending menthol rule. The act preserves an exemption for premium cigars and shisha sold in age-restricted hookah lounges licensed before 2021.
Selling banned flavored products triggers $1,000 first-offense fines, $5,000 second-offense, and tobacco retail license suspension up to 30 days for third offenses under DC Code 7-1803.04.
