Full Breakdown
Boone County Code § 50.027 requires that solid waste containers "shall be placed at the curb, alley, or the rear of the building for collection," and sets the timing window precisely: a container "placed at the curb or alley for collection shall be so placed not more than 12 hours before collection" and "shall be removed from the curb or alley not more than 12 hours after collection." The container itself must meet the standards in § 50.012: residential solid waste goes in containers of "not more than 35 gallon capacity" unless supplied by a permitted hauler, must be "leak-proof, waterproof, and fitted with a fly-tight lid" and kept covered except when in use, and the loaded container "shall not exceed 75 pounds." Galvanized metal, or rubber, fiberglass or plastic that will not turn brittle in cold weather, are the acceptable materials, and every container "must be of a type and construction that will not allow access to the waste by dogs, cats, rodents or any other animals." Commercial containers follow the same waterproof, leak-proof, covered standard under § 50.012(B), sized as the County Solid Waste Coordinator recommends and the Fiscal Court approves. These placement and container rules apply only in unincorporated Boone County; Florence, Union and Walton run separate cart programs under their own codes.
Violations & Fines
Setting a cart out early, leaving it at the curb past the 12-hour window, or using a container that is oversized, unsealed or not animal-proof violates §§ 50.012 and 50.027, both within the range that § 50.999(A)(1)(a) fines at $25 per day, with each day of continued noncompliance a separate offense.
