Stafford County, VA Trash & Recycling: Bin Placement Rules (2026)

Section 21-53 requires the owner of any residence or establishment where people live, gather, or work to provide enough refuse containers to handle the trash that accumulates between scheduled pickups. For anything other than a single-family dwelling, meaning apartments, condos, and commercial or institutional buildings, the containers must be the mechanical, dumpster-style type manipulated by mechanical means and built of durable plastic or metal. Those containers must sit on-site at ground level, stay outside every vehicle travel lane, and be screened from view, though the code allows a building to route trash into the container through an enclosed chute instead of keeping the container in the open.

The container rule sits inside Article IV of Chapter 21, which the Director of Planning and Zoning, or their designee, enforces. The Director can enter private property at a reasonable time to check compliance, and if entry is refused can apply to a magistrate for a warrant under Section 21-55. Article IV also covers what happens once trash piles up outside a proper container: under Section 21-54, the county can order an owner by certified mail or hand delivery to clean up trash, garbage, or refuse that endangers the health or safety of others, and can do the work itself and bill the owner, with unpaid bills added to the property tax bill, if the owner fails to comply.
