Full Breakdown

The county's Unified Development Ordinance treats a garbage or recycling cart as "outdoor storage" for zoning purposes, and outdoor storage of goods, materials, or refuse containers is normally forbidden inside any required road setback under UDO Sec. 2(2)(b). The ordinance then carves out one narrow exception: residential property owners may temporarily move their containers into that setback strip for curbside pick-up, so long as the placement is temporary rather than a permanent storage spot for the cart between collection days. Outside of that pickup-day window, carts belong back on the buildable side of the setback line with other stored materials.

1 (Commercial Recycling), residents may either haul their own recyclables to a county drop-off site or contract with a licensed hauler for curbside collection under Sec. 1-3(b)(2); haulers must hold an annual county vehicle license under Sec. 1-4 that expires every July 31. Once a resident's refuse or recyclables are set out for authorized collection, ownership and handling responsibility stay with the resident only until the licensed hauler removes them, per the ownership provisions the code applies to residential set-outs.

Violations & Fines

Anyone who scavenges municipal waste or recyclable materials already set out by a resident, business, or the county for authorized collection faces a fine of up to $500.00 under Sec. 7.1-5(a)(3), with each day of continued violation charged as a separate offense. Licensed haulers who violate the recycling chapter face escalating civil penalties starting at $50 for a first offense, $100 for a second, and $200 for a third, rising to a 14-day license suspension on a fourth violation.

Frequently Asked Questions

Can I leave my garbage cart at the curb every day in Peoria County?
No. The road setback exception only covers temporary placement for pick-up under UDO Sec. 6.1.2(2)(b). Outside of pick-up day, a cart left permanently in the setback counts as prohibited outdoor storage and can draw a zoning violation from the Planning and Zoning Department.
Is it illegal to take items out of a neighbor's recycling bin in Peoria County?
Yes. Once materials are set out for an authorized collection, Sec. 7.1-5(a)(3) makes scavenging them a violation punishable by a fine of up to $500 per day, whether the bin belongs to a resident, a business, or the county.
Does Peoria County require a license to haul curbside recycling?
Yes. Under Sec. 7.1-4, anyone collecting or hauling garbage, recyclables, or other refuse in the county needs a vehicle license from Peoria County that must be renewed by July 31 each year, in addition to any required business license.
