Full Breakdown

Section 106-41(a) of the Solid Waste Code lays out the frequency and timing of mandatory residential service. Class I Collection, meaning curbside pickup, consists of once-per-week collection of properly prepared Residential Waste under § 106-41(a)(4). Class II Collection, the dumpster-based service typically used by multi-family properties, must run a minimum of once per week under § 106-41(a)(5). Both classes are locked to a fixed schedule: the Franchisee performs residential collection Monday through Friday only, except during holiday weeks or when the Executive Director authorizes otherwise, and every customer is serviced on the same day each week rather than a rotating date.

On the commercial side, § 106-41(c) sets a different cadence: putrescible solid waste, the food-scrap and organic-waste stream, from any commercial or industrial entity must be collected a minimum of once per week, while other commercial waste excluding putrescible waste, extraordinary waste and sludge is collected a minimum of once every two weeks, and program recyclables from commercial and industrial customers are collected at least once every two weeks as well. The Franchisee is not required to run service on Christmas, New Year's Day, July 4th, Labor Day or Thanksgiving; when a holiday falls on a normal collection day, the Franchisee must notify affected customers of the alternate pickup date the Solid Waste Management Department assigns.

Violations & Fines

A Franchisee that departs from the required weekly (or twice-monthly, for eligible commercial waste) schedule or skips the required same-day-each-week servicing is subject to Solid Waste Management Department enforcement of the Franchise Agreement under § 106-58(l)-(n), including revocation proceedings before the Board and liability for the County's investigation costs if a violation is found at a public hearing.
