Full Breakdown
Section 8-58.1 assesses a solid waste service or user fee of $222.00 per year per residential unit to help defray the costs of collecting and disposing of solid waste. The charge falls on the property owner of each residential unit, and the section states that this covers the incorporated and unincorporated areas of the county. The county treasurer collects it at the same time and in the same manner as real property taxes, and it appears as a separate line on real property tax notices. Properties exempt from ad valorem taxes receive a separate invoice mailed on or about the time tax notices go out, due by January 15 of each succeeding year.
Unpaid fees are treated like overdue real property taxes: the same penalties and interest apply, the county pursues all legal remedies, and the owner is responsible for collection costs including reasonable attorney fees.
The definition of residential unit decides the bill. It is a house or other structure in which a person or persons live, or one designed for habitation whether or not actually used for habitation. In a building designed for more than one family, each unit or apartment is a separate residence and is assessed a separate fee. Mobile homes and modular homes designed for or used for human habitation count. The county assessor, with the assistance of the county building officials office, documents the number of residential units on each parcel.
The money goes into a separate, segregated fund and pays for collection, disposal, transfer and recycling of solid waste, equipment and facilities, litter pickup and educational programs. The county publishes the annual total on its website, and county council can change the amount through its budget ordinance. Ordinance No. 2026-11 adopted the section on June 29, 2026. The provisions quoted here set the fee and do not name pickup days. Container rules sit in Sections 8-59 and 8-60.
Violations & Fines
Nonpayment is handled as tax delinquency in this section. Section 8-58.1(a) applies the same penalties and interest as overdue real property taxes, directs the county to pursue all legal remedies, and holds the owner responsible for all costs of collection, including reasonable attorney fees. Section 8-58.1(e) allows no exemption for a residential unit that receives county collection and disposal.
