Violations & Fines
Failure to run the required weekly schedule and equipment is a per-day ordinance violation under § 50.02(G). Any officer of the County Police Department, County Engineer, or County Director of Weights and Measures may issue a citation, and the Board's assigned attorney civilly prosecutes the case in county circuit or superior court, styled "Clark County Indiana vs." the hauler. Upon proof by a preponderance of the evidence, the court enters a per-day-of-violation money judgment plus the county's costs and attorney's fees, and may also issue a cease-and-desist order barring the hauler from any solid waste or recycling business in the county until it files written proof of cure with the court, the Board and the County Engineer.
