Section 240.355 makes trash service an obligation of occupancy rather than a service a household chooses to buy. For all residential or non-residential premises where solid wastes are generated, the persons responsible for complying with the Article shall contract for the collection of solid waste. Burning it, burying it, or letting it accumulate is not an alternative the section leaves open.

The contract has to be with a specific kind of company. The hauler must serve the premises and hold an annual solid waste collection and transportation permit issued by the Division Director. That permit is what makes the arrangement count, so hiring an unpermitted operator does not satisfy the requirement even though someone is hauling the waste away. Because the permit is annual, a hauler's standing has to be current, not merely held at some point in the past.

The code then sets the floor for how often the waste moves. Solid waste shall be collected not less often than once per week. That is a minimum rather than a schedule: a hauler may run more frequently, and a commercial property generating more waste is not excused from weekly pickup because its container is not full.

Where no permitted hauler serves an area, the obligation does not disappear. It shifts to the property owner, who must transport the solid waste to a licensed landfill, processing facility, or transfer station, and must do so at the same minimum of once per week. Recyclables are handled on the same weekly cadence as solid waste. Containers are to be set out no earlier than dusk on the day before pickup, which keeps carts off the roadside for days at a time between collections.
