City Code § 140-3 authorizes the Commissioner of Public Works to adopt and issue standard rules governing how garbage, rubbish and other refuse are sorted, placed and removed, including the specific times of day collection happens. Any such rule must be filed with the City Clerk and does not take effect until 10 days after filing, giving residents notice before a schedule changes. The section also protects service levels directly: the Commissioner cannot use this rulemaking power to reduce the number of garbage collections except during an emergency proclaimed by the Mayor.

For owners or occupants of buildings with three units or fewer who want their cans picked up and returned from somewhere other than the curb, § 140-4 lets them apply in writing to the City Clerk for additional service at a fee of $15 per family per calendar month, billed and collectible semiannually in January and July, with the City Clerk transmitting payments to the Comptroller monthly.
