Full Breakdown
Section 23-30 imposes mandatory collection service on two groups: anyone residing in a designated congested area, and every commercial or industrial establishment countywide, regardless of location. Both must obtain service from a Contractor holding a valid solid waste, recyclables and green waste collection permit issued by the Department of Resource Management, Environmental Health Services Division for that particular Service Area. The county is divided into five such areas, A through E, mapped and incorporated by reference into Chapter 23 under Section 23-31, and the Board of Supervisors can adjust those boundaries by resolution.
Section 23-33 requires the Division to issue collection permits only to established collectors capable of handling the waste stream, and requires each permitted collector to post a minimum $50,000 security bond to guarantee continuous, faithful service under the permit terms. Section 23-34 ties a permittee's authority to the specific territory listed in its permit, so a contractor authorized in one service area cannot legally collect in another. A property owner who wants out of this system has one avenue: Section 23-38 lets a dwelling owner in a mandatory service area apply for a written exemption, but without that exemption the mandatory service obligation under Section 23-30 stands regardless of whether the resident would prefer to self-haul.
Violations & Fines
Residing in a congested area, or operating a commercial or industrial establishment, without obtaining service from a permitted Contractor for the applicable Service Area violates Section 23-30's mandatory service requirement. A contractor collecting outside its permitted territory separately violates Section 23-34.
