In addition, each Container, regardless of purpose, shall be:i.Free from jagged and sharp edges;ii.Free from inside structures and bracing, such as inside bands and reinforcing angles, which would prevent free discharge of the contents; and,iii.Equipped with suitable handles, lifting lugs, and equipment to enable the Franchisee to lift, empty, and otherwise handle the Container with its standard equipment.(c)...the substandard Container shall be repaired or removed from service by its owner within seventy-two (72) hours else it shall thereafter be removed and destroyed by the Franchisee.

B). Franchisees must furnish containers in every size from two through fifty cubic yards with lifting connections that match the hauler's collection equipment, and every garbage container must be watertight, made of impervious material, and fitted with a tight cover to keep out flies, insects and rats. Containers must also be free of jagged edges and internal bracing that could block them from emptying, and equipped with the handles and lifting lugs the hauler's trucks need. Ownership defaults to the franchisee unless the county approves other arrangements, and a container that fails these standards must be marked describing the defect and then repaired or removed from service within seventy-two hours, after which the franchisee must destroy it.
Each container must carry the franchisee's name and local phone number on at least two sides in a marked field between one and one-quarter and thirteen square feet, and no other advertising, sign or logo may be posted on a container. m. 6.
Violations & Fines
Collecting waste without a Clay County franchise, or violating the container noise-and-hours rule in Section IV.5.B(3), is graded under Section 15-20: category 6 for a first offense, category 8 for a second, category 10 for a habitual violation, which can then be prosecuted as a misdemeanor punishable by up to $500 or sixty days in jail. Willful violation of any other container requirement is a general second-degree misdemeanor under Section VIII.4, and dumping into someone else's franchised container without permission is punishable as littering under Section 10-1(f) and F.S. § 403.413(5).
