It shall be unlawful for any person to own, use or possess a refuse container or refuse compactor that is visible from view of ground-level pedestrian traffic on the right-of-way of the road, within 115 feet of the centerline of the following roads and parts of roads:(1)County Road 3031 (Thomas Drive);(2)U.S. 98A (Front Beach Road);(3)That portion of U.S. 98 commencing at the west end of Hathaway Bridge and terminating at the intersection of U.S. 98A near the Hathaway Bridge; and(4)That portion of U.S. 98 commencing at the intersection of U.S. 98 near the Phillips Inlet Bridge and terminating at the eastern end of the Phillips Inlet Bridge. (c)Exceptions. Nothing in this section shall prohibit:(1)The temporary ownership, use or possession of a refuse container intended and used exclusively to collect and store construction debris for removal, provided that a valid construction permit has been issued by the county for the construction site on which such container is located, construction is progressing, and such container is used exclusively for construction debris generated on that site.
