Summary
Dumpsters, garbage cans and other refuse containers can't be visible to ground-level pedestrians within 115 feet of the centerline of Thomas Drive, Front Beach Road, or the Hathaway and Phillips Inlet bridge approaches under Bay County Code Sec. 22-1. Construction-site roll-off dumpsters get a pass while a valid county building permit stays active, and the Board of County Commissioners can grant a hardship variance.
(b)Units visible to pedestrians prohibited. It shall be unlawful for any person to own, use or possess a refuse container or refuse compactor that is visible from view of ground-level pedestrian traffic on the right-of-way of the road, within 115 feet of the centerline of the following roads and parts of roads:(1)County Road 3031 (Thomas Drive);(2)U.S. 98A (Front Beach Road);(3)That portion of U.S. 98 commencing at the west end of Hathaway Bridge and terminating at the intersection of U.S. 98A near the Hathaway Bridge; and(4)That portion of U.S. 98 commencing at the intersection of U.S. 98 near the Phillips Inlet Bridge and terminating at the eastern end of the Phillips Inlet Bridge. (c)Exceptions. Nothing in this section shall prohibit:(1)The temporary ownership, use or possession of a refuse container intended and used exclusively to collect and store construction debris for removal, provided that a valid construction permit has been issued by the county for the construction site on which such container is located, construction is progressing, and such container is used exclusively for construction debris generated on that site.
Full Breakdown
Sec. 22-1 defines a "refuse container" broadly to include garbage cans, dumpsters and even vehicles used to store and remove waste, and a "refuse compactor" as any device that compresses refuse. S. S. S. 98 near the Phillips Inlet Bridge, no such container or compactor may sit within 115 feet of the road's centerline where it's visible from ground-level pedestrian traffic on the right-of-way. Two exceptions apply: a temporary construction-debris container is allowed if a valid county construction permit is active and the container is used solely for debris from that site, and any single litter receptacle of 55 gallons or less intended for general public use is always permitted if kept clean.
Property owners facing unnecessary hardship not of their own making can ask the Board of County Commissioners for a variance under continuing terms the board sets. The rule targets the county's two busiest tourist corridors on Panama City Beach and the Hathaway/Phillips Inlet bridge approaches, aiming to keep commercial dumpsters out of view of beachgoers and drivers along those specific rights-of-way rather than regulating dumpster placement countywide.
Violations & Fines
Failing to comply with Sec. 22-1 is punished under the county's general penalty, Sec. 1-6: a fine up to $500.00, up to 60 days in the county jail, or both, with continuing noncompliance chargeable as a separate violation for each day it persists. A property or business owner cited under this section may ask the Board of County Commissioners for a variance rather than, or in addition to, contesting the citation.
