Commercial properties in unincorporated Volusia County must screen every trash bin or dumpster on at least three sides with a six-foot fence or wall, set it on a concrete or asphalt pad level with the service truck, and keep it out of the street right-of-way, per Sec. 106-37.
(f)Placement of containers; enclosure; base. All commercial refuse bins, except approved recycling containers, shall be enclosed on at least three sides with a six-foot-high screen. The screen shall consist of a wood or cyclone slat fence or masonry wall or other approved screening material. The bin shall be enclosed in such a manner that said bin will be screened from public streets and adjoining properties. A concrete or asphalt pad or other approved material shall be provided as a base for the bin. The pad shall be at the approximate level of the service vehicle approach area so that the truck loading mechanism can align with the container's sleeves. The screened enclosure area or container shall not be located within any street right-of-way. Existing commercial properties shall have six months from the effective date of the ordinance from which this subsection is derived to comply with these provisions.

Full Breakdown
Sec. 106-37 sets the physical standard for every commercial refuse bin or dumpster in the unincorporated county. Subsection (c) makes owners/occupants of commercial property responsible for providing approved containers or refuse bins adequate to hold all the solid waste the property generates; the bin can be leased from the franchised collector, but the owner/occupant must keep both the container and its immediate area clean and sanitary, and overflow from an over-filled bin will not be picked up. Subsection (d) lets the franchised collector condemn and mark any privately owned bin that is in disrepair, missing a well-fitting lid, or holed, cracked, or torn at the bottom or sides, and the owner/occupant must replace it immediately.
Subsection (e) bars customers from letting people, objects, or vehicles block the collector's access for servicing. Subsection (f) is the enclosure spec: every commercial refuse bin except approved recycling containers must be screened on at least three sides by a six-foot-high wood or cyclone-slat fence, masonry wall, or other approved material, arranged so the bin cannot be seen from public streets or adjoining properties, and set on a concrete or asphalt pad graded to the service truck's approach so the loading mechanism lines up with the container's sleeves.
The enclosure or bin itself cannot sit within any street right-of-way. Existing commercial properties got six months from the ordinance's 1990 effective date to come into compliance.
Violations & Fines
Placing an unscreened dumpster, one without the required six-foot enclosure, or one sitting in the street right-of-way violates Sec. 106-37(f) and is punishable under the general penalty in Sec. 1-7: up to a $500.00 fine, up to 60 days in jail, or both, with continuing noncompliance charged as a separate daily offense.
