Owensboro Municipal Code § 26-282 puts the establishment, not the city, in charge of the physical setup: each business must furnish the container's storage location, enclosure, ingress and egress route, container pad and apron, and keep all of it maintained, subject to the sanitation manager's approval of the placement itself. Roll-off containers are not a standard sanitation department service; a business must contact the sanitation manager for individual authorization, and if the roll-off sits within a city right-of-way, the placement also requires an encroachment permit from the city engineering department, a separate approval layer on top of the sanitation manager's sign-off.

Section 26-298 governs how the containers themselves must be kept once in place: material has to be placed so lids close and doors shut, overfull containers can be billed at 1.5 times the standard rate, and no debris may be piled on top of or around a container. Purchased bulk containers must be kept in acceptable, operating condition, including doors, lids and lift attachments; a container that fails is tagged out of service by the sanitation manager, and the owner is directed to repair or replace it.

Failing to remedy a tagged-out container is a Code violation, cited by the code official, carrying a fine of no less than $100 and up to $500, and the owner may be required to lease a replacement until the repair is complete. Together these sections mean placement, permitting and physical condition of a commercial dumpster are all separately enforceable.
