Summary
Rochester City Code § 8-3-3 treats a construction dumpster, roll-off, or compactor left on a residential lot as a public nuisance once it overstays its welcome. A dumpster may sit on a site zoned R-Sa, R-1, R-1x, R-2, R-3, or R-4 for up to 90 days a year and must not block traffic; it must come down within five days of permit expiration or final inspection.
(a)The common council finds that dumpsters on residential property are necessary for temporary projects such as remodeling, clean up, landscaping, renovations and construction activities. However, the extended presence of dumpsters on residential property may cause aesthetic, health and safety concerns, especially for adjacent property owners, and, as such, are declared to be public nuisances. The council determines it is in the best interests of the public's health, safety, comfort, peace, tranquility and general welfare to limit the use of dumpsters on residential property.(b)A dumpster may be temporarily located on a site so long as it does not obstruct vehicular or pedestrian traffic. A dumpster may remain at a site for up to 90 days during any calendar year. A dumpster must be removed within five calendar days of the expiration of a building permit, passage of all final inspections or issuance of a certificate of occupancy (whichever is later).

Full Breakdown
Rochester City Code § 8-3-1(b) defines a regulated "dumpster" as a portable open-top container, compactor, roll-off, or recycling container used temporarily to collect construction waste from an active permitted construction project, a house clean, or similar temporary use, and the term excludes a small enclosed permanent container of eight cubic yards or less used for regular household garbage service. The rule applies only to a "site," meaning land zoned R-Sa, R-1, R-1x, R-2, R-3, or R-4 under § 8-3-1(c), so a commercially or industrially zoned property is outside this particular section.
Section 8-3-3(b) sets the operating rules: a dumpster may sit on a residential site as long as it does not obstruct vehicular or pedestrian traffic, it may remain there for up to 90 days during any calendar year, and it must be removed within five calendar days of whichever comes last among the building permit expiring, all final inspections passing, or a certificate of occupancy issuing. Section 8-3-3(c) lets the common council grant a permit allowing the dumpster to stay beyond 90 days, on terms the council sets, after weighing whether the applicant has shown sufficient cause, whether construction, remodeling, or renovation is still active on site, how visible the dumpster is to neighboring properties, and whether health, safety, or welfare concerns are involved; the council may attach conditions to any such permit.
Section 8-3-1(a) frames the whole chapter around the council's finding that dumpsters left filled with construction debris for extended periods threaten health, safety, and welfare, which is why the 90-day default applies without a council permit.
Violations & Fines
Keeping a dumpster on a residential site beyond 90 days without a council permit, or violating the conditions of a permit granted under § 8-3-3(c), is a misdemeanor under § 8-3-3(d). Under the Code's general penalty, § 1-1-11(c), that can carry a fine up to $1,000.00, up to 90 days in jail, or both, and each day it remains can be charged as a separate offense.
