Sec. 3 requires any new, substantially remodeled, or expanded use needing an enclosure (defined as work equal to 51% or more of the structure's replacement value, as determined by the Director of Community Development) to submit a design reviewed and endorsed in writing by the franchise hauler before the county's Planning Division will approve it.

A violation of Sec. 9-6's enclosure or design requirements is punishable as an infraction by a fine of up to $100 or as a misdemeanor by a fine of up to $500, imprisonment in the County Jail for up to six months, or both, under Sec. 9-9.1, with each day of noncompliance a separate offense.
