Commercial dumpster service in Tampa runs through § 26-166 of the solid waste code. Under subsection (d), 'for apartments with four (4) or more units and for certain other commercial customers, service will be rendered by refuse bins if feasible or by bulk service if bins are not feasible at the determination of the director', the choice between a dumpster and curbside bulk pickup is the Department's call, not the property owner's. Two adjacent businesses may share a single bin under subsection (g), but only if their premises are 'adjacent to or directly behind each other' and the account holder submits a written request.
Every open-top container must be enclosed under subsection (h) 'to prevent any materials from being windblown,' and subsection (i) bars using an open-top container for 'putrescible solid waste' at all. New commercial accounts requesting bin service must build 'an aesthetically pleasing enclosure and suitable slab for the bin' under subsection (j), and every bin must have working lid covers kept closed 'at all times to prevent spillage' under subsection (k); spillage from a non-conforming bin or enclosure will not be picked up under subsection (l).
In the Downtown Core Business District, subsection (m) further restricts collection to 'solid waste placed in city-issued containers or PAYT bags', a Pay-As-You-Throw bag system, so a downtown business cannot simply set out a private dumpster the Department hasn't authorized.
Violations & Fines
A privately placed or unenclosed dumpster, an open-top bin used for putrescible waste, or spillage from a bin without working lids will not be serviced under § 26-166(i), (k) and (l) until the owner corrects it, and the property can be cited under the general penalty, § 1-6, for up to $500 and 60 days in jail per day the condition continues.
