Full Breakdown

04 requires every Single-Family Organic Waste Generator to subscribe to the City's collection services for all Organic Waste, place Source Separated Green Container Organic Waste, including food waste, in the green cart, recyclables in the blue cart, and trash in the gray cart, and prohibits mixing gray-cart waste into the green or blue carts. 03 expressly includes any Multi-Family Residential Dwelling of five units or more; buildings with fewer than five units are exempt from the commercial rules. Commercial generators must also supply labeled containers in customer areas, train employees annually, inspect containers daily for contamination, and give new tenants sorting instructions within 14 days of move-in.

08 by documenting that its organic waste is under 20 gallons per applicable container per week where its total waste service is two cubic yards or more, or under 10 gallons per week where total service is less than two cubic yards; waiver eligibility must be reverified every five years. 16 to check compliance. From January 1, 2022 through December 31, 2023, noncompliant generators received education materials and a compliance deadline instead of penalties; civil penalties for noncompliance began January 1, 2024.

Violations & Fines

Civil penalty amounts follow the general schedule in Sections 1-6.01 and 1-8.09 of the Municipal Code. The City must first issue a Notice of Violation and may extend the compliance deadline for acts of God, permit delays, or documented recycling-infrastructure shortfalls. Administrative citations may be appealed under Title 1 of the Municipal Code. Enforcement escalated from education-only to civil penalties on January 1, 2024, per Section 8-21.17.

Frequently Asked Questions

Do apartment buildings have to separate food scraps in Santa Maria?
Yes, if the property has five or more units. Section 8-21.03 counts a Multi-Family Residential Dwelling of five units or more as a Commercial Business, so it must subscribe to organics collection and provide sorting containers under Section 8-21.06. Buildings with fewer than five units are not subject to the commercial container and labeling rules.
Can a small business skip organics recycling in Santa Maria?
Only with an approved de minimis waiver. Section 8-21.08 lets the City waive some or all requirements if the business documents its organic waste stays under 20 gallons per container per week (two-plus cubic yard service) or 10 gallons per week (smaller service), and re-verifies eligibility every five years.
What happens if I don't comply with Santa Maria's organics ordinance?
Through 2023 the City provided education and a compliance deadline instead of penalties. Since January 1, 2024, Section 8-21.17 authorizes the City to document noncompliance, issue a Notice of Violation, and pursue civil penalties under Sections 1-6.01 and 1-8.09, with appeals available under Title 1 of the Municipal Code.
