Utica requires every person to separate recyclables from other solid waste, with the Commissioner defining what counts and how to separate. Recyclables set at the curb must be in the City recycling container, and no non-recyclables may be put in that container.
City Code Chapter 2-22, Article V makes recycling mandatory. Section 2-22-121 requires each person to provide for the separation of recyclables from other solid waste, with the Commissioner determining what constitutes recyclables and the separation requirements. Section 2-22-124 requires use of the City recycling container: except where authorized in writing, no person may place recyclables at curbside in any receptacle other than the City recycling (orange) container, and no non-recyclable material may be deposited in it. Only those using public solid-waste collection may use public recycling collection; residents may instead sell or donate recyclables to authorized recyclers off the curb.
Failing to separate recyclables or contaminating the recycling container is a Chapter 2-22 violation; solid-waste offenses carry a fine up to $250 or up to 15 days.
