Ventura County Zoning Ordinance §8107-25 protects all oaks and sycamores 9.5 inches in circumference or larger (measured at 4.5 feet above ground), trees of any species with a historical designation, and any tree 90 inches or more in circumference. Section 8107-25 establishes comprehensive tree protection regulations. Protected trees include all oaks and sycamores 9.5 inches in circumference or larger (measured at least 4.5 feet above ground), any tree with a historical designation regardless of species, any tree 90 inches or more in circumference, and most native trees 9.5 inches or more in the Scenic Resources Protection zone. The ordinance requires a discretionary Tree Permit from the Planning Director before any alteration, felling, or removal of a protected tree. If minor pruning can solve a compatibility problem, removal will not be approved. Trees may not be removed for aesthetic or view reasons.
Unpermitted removal of a protected tree violates §8107-25 and is subject to penalties under §13-2. Violators may be required to replant at replacement ratios determined by the Planning Director. Replacement trees must be maintained and monitored. Civil liability for the value of mature trees can reach $10,000-$50,000+. Criminal prosecution as a misdemeanor carries up to $1,000 fine and 6 months imprisonment.
