Summary

Jefferson Parish protects mature trees through the Metairie Ridge Tree Preservation District overlay and parish-wide protected-tree standards. Oaks, elms, magnolias, sycamores and any canopy tree with an 8-inch or greater trunk diameter, plus any tree 24 inches or wider, cannot be cut, cleared or damaged by construction without a permit from the parish arborist, and unauthorized removal triggers fines and forced replacement.

These county ordinances apply to unincorporated areas of Jefferson Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

The intent and purpose of the Metairie Ridge Tree Preservation District is to create and apply an overlay zone intended to protect the existing tree canopy in the preservation district and facilitate the maintenance and planting of trees in Jefferson Parish. The Metairie Ridge Tree Preservation District shall also facilitate related urban forestry activities in this district, maintain and add aesthetic appeal, increase comfort and property values in this district, and generally improve the quality of the environment in the Metairie Ridge Tree Preservation District.

Full Breakdown

The MRTPD is an overlay zone covering part of Metairie Ridge, bounded roughly by Bonnabel Boulevard, Interstate 10, Metairie Road, the Norfolk Southern Railroad tracks and the 17th Street Canal. Inside it, and in any other zoning district where the code requires tree preservation, a 'protected tree' includes every oak (except water oak), elm, magnolia and sycamore of 8 inches or more in diameter at breast height (DBH), plus any other canopy tree of 24 inches DBH or larger. No protected tree can be cut, cleared, or have its root protection zone disturbed by grading, trenching, or construction without a development approval.

Minor work such as fence installation or driveway paving is reviewed by the building permits department; major work such as demolition, new construction, or any tree removal goes through the planning department or the department of parkways, where the parish arborist has ten business days to make a recommendation. A tree protection plan sealed by a licensed landscape architect, contractor, or arborist is required for major construction, specifying a six-foot protective barrier around each tree. Removal is allowed only if the tree is diseased or hazardous, or if it falls in an 'uncontested removal area,' generally the buildable portion of the lot inside the front and rear setbacks.

Removed significant trees must be replaced at a one-inch-DBH-to-one-inch-caliper ratio up to 12 inches, plus $100 per additional inch of diameter beyond that, payable on-site or as a fee-in-lieu to the parkways department's tree fund. Storm-damaged trees may be removed immediately in an emergency, but the owner must file for a permit within 30 days and replace the tree 1-to-1. Decisions of the parkways director, planning director, or building permits director can be appealed to the Board of Zoning Adjustments within 30 days.

Violations & Fines

Unlawful removal or damage to a protected tree is punishable by up to $500 per violation per day, with proceeds dedicated to the parkways department's tree fund. A property owner who removes a protected tree without approval must retroactively obtain a permit and pay double the standard replacement or fee-in-lieu rate. Knowingly submitting false information on a tree permit application is also a violation, and a state-licensed professional who does so can lose their parish license.

Frequently Asked Questions

Do I need a permit to remove a large oak tree on my Jefferson Parish property?
Yes if it qualifies as a protected tree, meaning it is an oak, elm, magnolia, or sycamore of at least 8 inches in diameter, or any canopy tree of 24 inches or more. You must apply through the building permits or planning department, and if the tree is healthy, you must replace it on-site or pay a fee-in-lieu to the parish under section 33-6.27.10.
What happens if a hurricane damages a protected tree on my property?
You can remove it immediately without waiting for a permit if it poses a danger, but you must file a tree removal permit within 30 days of the emergency removal and replace the tree on a one-to-one basis. A landscape architect, contractor, or arborist must certify in writing that the removal was necessary.
What is the Metairie Ridge Tree Preservation District?
It is an overlay zoning district covering part of Metairie Ridge, bounded by Bonnabel Boulevard, Interstate 10, Metairie Road, the Norfolk Southern tracks, and the 17th Street Canal, created to protect the area's mature tree canopy. Development inside the district must meet both the underlying zoning rules and the parish's protected-tree standards, whichever is stricter.
What is the fine for cutting down a protected tree without a permit?
The parish can fine you up to $500 per violation per day, and you still must retroactively obtain a permit and replace the tree at double the normal replacement ratio or pay double the fee-in-lieu amount to the parkways department.
