A. An application for permit to plant one or more trees or shrubs on planting strips or other city property shall state the number of plants to be planted; the planting location and its proximity to overhead lines, street intersections, etc.; the species, cultivar or variety of each plant; the plans for care and maintenance of new planting; and such other information as the city forester shall find necessary to a fair determination of whether or not a permit should be issued. B. Whenever any tree or shrub is planted in conflict with the provisions of this chapter, it is lawful for the city forester to remove or cause removal of the same. C. In issuing permits for the planting of trees or shrubs on city planting strips, the city forester shall follow the guidelines as set forth in resolution 93-28 as to the variety of trees that may be planted on planting strips of various widths as set forth in that resolution.
Full Breakdown
Section 12.12.100 of the Logan Municipal Code governs what goes into the application and what the city forester may approve. The application must state the number of plants to be planted; the planting location and its proximity to overhead lines, street intersections and similar features; the species, cultivar or variety of each plant; and the plans for care and maintenance of the new planting. The city forester can also require other information needed for a fair determination.
Strip width drives the species choice. Under subsection C, the forester follows the guidelines in resolution 93-28 as to the variety of trees that may be planted on planting strips of various widths. Section 12.12.060 adds that the board's regulations carry a list of approved species for public streets. A tree planted in conflict with the chapter can be removed by the city forester under subsection B.
The permit itself comes from § 12.12.090: application at the city offices not less than forty eight (48) hours before the work, a permit that expires thirty (30) days after issuance unless designated otherwise, and notice of completion to the city forester within five (5) days. Section 12.12.105 defines a park strip as the area within the public right of way between sidewalk and curb and gutter, and requires planting of the strip to comply with title 12 and with current regulations of the Logan City Land Development Code. Section 12.12.120 makes the abutting owner responsible for lawn or shrubbery in the park strip, to the extent of preventing infringement of vegetation on gutters, streets and sidewalks. Section 12.12.150 requires a substantial fence, frame or box around city trees near construction.
Violations & Fines
Planting without a permit or against the chapter exposes the planter to removal of the plants by the city forester under § 12.12.100(B). Violation of any provision of chapter 12.12 is a class C misdemeanor under § 12.12.210, and the forester's notice must give no less than ten (10) days to correct under § 12.12.080.
