Summary
Every development project inside Brockton's Downtown Brockton Smart Growth Overlay District (DBSGOD) must comply with a separate Design Standards document, approved by the state Department of Housing and Community Development on July 23, 2007, in addition to the dimensional rules in City Code § 27-97. The planning board adopts and files the standards with the city clerk, and site plan approval depends on meeting them.
To ensure that new development shall be of high quality and shall be compatible with the character of building types, streetscapes, and other community features traditionally found in downtown Brockton, the planning board shall adopt the design standards approved by the department of housing and community development on July 23, 2007, as amended, relative to the issuance of site plan approvals for development projects within the DBSGOD and shall file a copy with the city clerk. In addition to the standards set forth in this article, development projects within the DBSGOD shall comply with such design standards.

Full Breakdown
The DBSGOD covers five subdistricts under Sec. 27-91: Arts/Culture, Corcoran, Downtown Core, Ralsco and Star Market, established under the state's Chapter 40R smart growth program to spur mixed-use and residential redevelopment around the Brockton Area Transit Intermodal Center and commuter rail station. Sec. 27-97 requires the planning board, acting as the DBSGOD's approving authority, to adopt the Design Standards for the Downtown Brockton Smart Growth Overlay District approved by DHCD on July 23, 2007, and to file a copy with the city clerk; those standards then govern architecture, streetscape and building character on top of the dimensional table in Sec.
27-94. Site plan review under Sec. 27-100 is the mechanism that enforces the design standards: applicants file with the approving authority, pay for peer review consultants held in an interest-bearing escrow account, and receive a decision within 120 days or the application is deemed approved. Sec. 27-98 requires any common open space or recreational area in a project to be shown on the site plan with a description of proposed ownership and maintenance. Sec. 27-99 layers an affordable housing requirement on top of the design standards, requiring at least 20 percent of dwelling units, and 25 percent in elderly or disability housing, to be affordable, and Sec. 27-101 allows the approving authority to waive other DBSGOD standards but never the affordable housing minimum below its floor.
Violations & Fines
A project that does not meet the Design Standards adopted under Sec. 27-97 fails the criteria for site plan approval in Sec. 27-100(5), and the approving authority can deny the application under Sec. 27-100(7) or grant conditional approval with conditions under Sec. 27-100(6) to bring the design into compliance. A denial or condition may be appealed to the superior court, land court, southeast housing court or district court within 20 days under Sec. 27-100(9).
