(A)General Purposes. The Downtown (D1) district and sub-districts are created for the purposes set forth herein and without limitation, for the promotion and preservation of the City's educational, cultural and economic interests, opportunities and advantages. The district includes and bounds the Downtown Design Overlay District and significant tourist routes providing access to historic structures, buildings and locations in downtown Portsmouth. (E)Fenestration Standards.(1)Street-level.(a)Nonresidential Uses. For nonresidential uses, a minimum of 50 percent of the building façade between two and eight feet in height along the street frontage shall be comprised of windows and/or doors.(b)Residential Uses. For residential uses, windows shall comprise a minimum of 30 percent of the building façade between two and eight feet in height along the street frontage, relative to the finished floor elevation.

The Downtown (D1) district is split into five sub-districts under Sec. 2-207. Front yard setbacks in T3 and T4 top out at 15 feet or the average of existing buildings along the same block face, while T5 and T6 allow a zero-foot minimum front setback. Building heights range from a 20-foot minimum with a 50-foot cap in T3/T4, up to a 100-foot cap in T5, and no maximum at all in T6, the district's most intense zone. T3 and T4 must also set aside at least 10 percent of the lot as open space; T5, T6, and SD carry no open-space requirement.

Violations & Fines
A property built without the required street-level glazing, without mechanical-equipment screening, or with a curb cut inside the 75-foot corner separation is out of compliance with Sec. 40.2-207 and can be denied a Certificate of Occupancy or ordered corrected by the Zoning Administrator, with continued zoning violations punishable under Sec. 40.2-553 by a fine of up to $1,000.00.
