California Gov. Code §65852.2(f)(3)(A) prohibits local agencies, special districts, and water/sewer agencies from imposing any impact fee on an ADU smaller than 750 square feet. For ADUs 750 sq ft or larger, §65852.2(f)(3)(B) requires impact fees to be charged 'proportionately in relation to the square footage of the primary dwelling unit' - typically computed as (ADU sq ft / primary dwelling sq ft) × full impact fee schedule. 'Impact fees' under this section include traffic, parks, school, drainage, fire, library, and similar fees - but exclude water/sewer connection fees, utility hookup charges, and standard building permit plan-check and inspection fees, which remain payable. JADUs (under 500 sq ft and inside the primary footprint) are also impact-fee exempt. Confirm Chino's current fee schedule with the Building Division and verify any utility connection fees through IEUA.
If Chino charges impact fees in excess of the state cap, applicants may protest under the Mitigation Fee Act (Gov. Code §66020) and seek refund within 90 days of payment.
