Summary

In unincorporated Kitsap County, road, park and school impact fees on an accessory dwelling unit cannot exceed fifty percent of the fee charged on the principal dwelling. The county still collects the fee before final inspection under Kitsap County Code Chapter 4.110.

These county ordinances apply to unincorporated areas of Kitsap County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

B. Except as otherwise provided for independent fee calculations in Section 4.110.230, exemptions in Section 4.110.030 and credits in Section 4.110.040, all new development other than accessory dwelling units (ADUs) will be charged the road impact fee applicable to the type of development in the road service area in which the development is located. Impact fees on ADUs may not exceed fifty percent of the impact fees that would be imposed on the principal unit.

Violations & Fines

Kitsap County Community Development enforces the fee through the permit process itself, not a citation: the department may not issue the required site development activity permit or certificate of occupancy under § 4.110.020(F) until impact fees are paid in full, net of exemptions and credits. Fees are due prior to final inspection of each unit under § 4.110.020(E), so an unpaid ADU impact fee simply blocks occupancy rather than triggering a separate fine.

Frequently Asked Questions

Does Kitsap County charge full impact fees on an ADU?
No. Under Kitsap County Code §§ 4.110.200(B), 4.110.210(B) and 4.110.220, road, park and school impact fees on an accessory dwelling unit may not exceed fifty percent of the fee that would be charged on the principal unit on the same lot.
When must the ADU impact fee be paid?
Section 4.110.020(E) requires payment prior to final inspection of the unit, using the impact fee rates in effect when the complete permit application was accepted. Section 4.110.020(F) blocks issuance of the certificate of occupancy until the fee is paid.
Do these impact fees apply inside Bremerton, Poulsbo, Port Orchard or Bainbridge Island?
No. Chapter 4.110 is a Kitsap County ordinance that reaches only unincorporated county land; each incorporated city sets and collects its own impact fees under its own municipal code.
Is there an extra administrative charge on top of the impact fee?
Yes. Section 4.110.110(B) adds a $20.00 administrative fee for each of the schools, parks and roads impact fees collected on a given permit, deposited into the county's Community Development Special Revenue Fund.
