Effective July 21, 2025, San Leandro City Council Resolutions 2025-106 and 2025-107 waive Park Impact Fees and Development Fees for Street Improvements (DFSI) for all ADUs; ADUs under 750 sq ft are exempt from all impact fees by state law.
On July 21, 2025, the San Leandro City Council adopted Resolution 2025-106 (Park Land Acquisition / Park Improvement Fee schedule, with ADU waiver) and Resolution 2025-107 (exempting ADUs from the Development Fees for Street Improvements, DFSI). As a result, ADUs in San Leandro are no longer subject to Park Impact Fees or DFSI regardless of size. Independently, California Gov. Code §66323(a) prohibits any impact fee on an ADU under 750 sq ft, and requires that fees on ADUs 750 sq ft or larger be charged proportionally to the primary dwelling's square footage. ADUs under 500 sq ft are also exempt from San Lorenzo Unified / San Leandro Unified school district fees under Ed. Code §17620 and Gov. Code §65995. Standard building permit, plan-check, and utility connection fees still apply per the FY 2025-2026 Master Fee Schedule.
Improperly assessed impact fees may be challenged under the Mitigation Fee Act (Gov. Code §66020). A property owner has 90 days from fee imposition to file a written protest. Failure to pay legally required permit/utility fees may delay permit issuance or final inspection.
