Full Breakdown
Under the county's ADU application rules, an owner who builds only an ADU does not have to live in the primary residence or the ADU. But if a single-family lot has both an ADU and a junior ADU (JADU), the owner must occupy either the JADU or the remaining portion of the house. For a JADU alone, the owner must already reside in the single-family dwelling at the time of application and, once built, must occupy either the remaining house or the JADU: except when the owner is a government agency, land trust or housing organization. Applies only to the unincorporated area.
Violations & Fines
Failing to meet the owner-occupancy requirement for a lot with a JADU can bar issuance of the building permit or trigger deed-restriction enforcement recorded against the property.
