Camarillo does not require the property owner to live on-site to operate an ADU permitted between January 1, 2020 and January 1, 2025, per AB 881 and Gov. Code Β§65852.2(a)(7). JADUs (Junior ADUs) under CMC 19.56 still require owner occupancy of either the JADU or the primary dwelling.
Under AB 881 (2019), codified at Gov. Code Β§65852.2(a)(7), local agencies β including Camarillo β cannot impose an owner-occupancy requirement on Accessory Dwelling Units permitted between January 1, 2020 and January 1, 2025. AB 976 (2023) extended that prohibition indefinitely for ADUs (not JADUs). CMC Chapter 19.56 conforms to state law on this point. Junior Accessory Dwelling Units (JADUs) β units up to 500 sq ft created within the walls of an existing single-family dwelling β are subject to a different rule: state law (Gov. Code Β§65852.22) and CMC 19.56 require owner-occupancy of either the JADU or the primary residence, and a recorded deed restriction memorializing the requirement and prohibiting STR use of the JADU. The owner-occupancy deed restriction for a JADU is recorded against the parcel with the Ventura County Recorder before final inspection.
Imposing an owner-occupancy requirement on an ADU in violation of Gov. Code Β§65852.2(a)(7) is unlawful β the City would have to remove the condition. For JADUs, breach of the recorded deed restriction (e.g., neither owner nor tenant living on-site) is enforceable through the deed restriction's remedies, including potential conversion order or fines under CMC Title 19 enforcement.
