City-specific rules exist: Thousand Oaks, Ventura, Oxnard, and Simi Valley have their own adu owner occupancy rules that differ from Ventura County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Full Breakdown

Under the county's ADU application rules, an owner who builds only an ADU does not have to live in the primary residence or the ADU. But if a single-family lot has both an ADU and a junior ADU (JADU), the owner must occupy either the JADU or the remaining portion of the house. For a JADU alone, the owner must already reside in the single-family dwelling at the time of application and, once built, must occupy either the remaining house or the JADU: except when the owner is a government agency, land trust or housing organization. Applies only to the unincorporated area.

Violations & Fines

Failing to meet the owner-occupancy requirement for a lot with a JADU can bar issuance of the building permit or trigger deed-restriction enforcement recorded against the property.

Frequently Asked Questions

Do I have to live on my property if I build an ADU in unincorporated Ventura County?
No, not if it's a standalone ADU. Owner-occupancy is only required if the lot has both an ADU and a JADU, or for a JADU on its own.
Can I rent out both the house and the ADU?
Yes, if you only have an ADU (no JADU) the owner doesn't have to occupy either unit, and each can be rented separately for terms longer than 30 days.
