Daly City ADUs and JADUs may not be rented for terms of 30 days or less. This is a statewide rule under Cal. Gov. Code 65852.2(a)(6) (ADUs) and Gov. The practical effect for Daly City property owners: an ADU may be leased month-to-month or on any fixed term of 31 days or longer, but cannot be listed on Airbnb, VRBO, Furnished Finder (when used for sub-30-day stays), or similar short-term-rental platforms. The Daly City Municipal Code itself does not authorize short-term rentals of ADUs - Title 5 (Business Licenses) and Title 14 (Zoning) do not create a separate STR carve-out that would override the state minimum. Tenant rental is also protected under AB 1482 (Civil Code 1946.2 and 1947.12), which caps annual rent increases at 5% + local CPI (max 10%) and imposes just-cause eviction for tenants of 12+ months in qualifying units. Note: ADUs newly built within the prior 15 years are exempt from AB 1482's rent cap (Civ. Code 1947.12(d)(1)).
Listing a Daly City ADU on a short-term-rental platform for sub-30-day stays violates Gov. Code 65852.2(a)(6) and the ADU's permit conditions. The city can issue Code Enforcement Notices of Violation, revoke the Certificate of Occupancy, and seek civil penalties. Platforms (Airbnb/VRBO) also remove listings flagged by local agencies.
