Under California Government Code Section 66314(a)(6), ADUs and JADUs in Lodi cannot be rented for terms shorter than 30 days, effectively banning Airbnb-style short-term rentals of accessory units.
While Lodi Municipal Code 17.36.130 implements ADU standards, the binding rental-term restriction comes from California Government Code Section 66314(a)(6) (formerly Gov. Code 65852.2(a)(6)), which prohibits any ADU or junior ADU from being rented for a term of less than 30 days. This applies citywide in Lodi regardless of whether the ADU is attached, detached, converted, or a JADU within the main dwelling. Longer-term rentals (30 days or more) are permitted and the ADU may be rented separately from the primary dwelling. Owners may not list the ADU on Airbnb, VRBO, or similar platforms for nightly or weekly stays. The ADU itself may not be sold separately from the primary residence (except under the limited SB 9 lot-split pathway codified at Gov. Code 66411.7).
Short-term rentals of ADUs violate California state law and Lodi's adopted zoning. Code enforcement under LMC Title 17 may issue cease-and-desist orders, and continued violations may lead to administrative citations or revocation of the certificate of occupancy.
